GENERAL
INFORMATION_________________________________________________________
The
Minimum Wage Ordinance insures that employees working in the City of Madison
shall be compensated for work paid whether based on time, piecework or
otherwise, sufficient to enable the employee receiving it to maintain him/
herself under conditions consistent with his or her welfare.
The Ordinance applies to most employers including any person, firm or
organization, agent, manager, representative, contractor or subcontractor or
principal, or any other person having control or direction of any person
employed at any labor or responsible directly or indirectly for the wage of
another.
Who
is covered?
All
employees including indentured apprentices, employed at private employments
including nonprofit organizations, whether paid on time, piece rate, commission,
or other basis for each hour of work performed within the City of Madison, this
includes the hours worked within the city limits of Madison for those employees
who work a minimum of at least two hours of their workweek in the City of
Madison.
Who
is not?
Any
individual engaged in house to house sales or delivery of newspapers, real
estate agents or salespersons
,(if
solely on commission), volunteers, elected political officers or their personal
staff, certain employees such as baby sitters, lawn care, snow removers, and
certain others who work on an irregular or intermittent basis for not more than
15 hours per week for any one household.
Exceptions:
Organizations
or institutions conducting programming for habilitation or rehabilitation for
the disabled workers and whom hold a subminumum wage license issued by the State
of Wisconsin, accredited school programs that employ student learners on a
part-time basis of 20 hours or less per week, (pursuant to a bona fide school
training program), facilities, and elementary and secondary schools for student
work-like activities that meet the criteria established in Wis. Admin. Code §
DWD 270.085.

how to file a complaint_______________________________________________________
Beginning January 1, 2005, if an employer fails to pay the employee the legal minimum wage in the City of Madison the employee may file a complaint with the City of Madison Equal Opportunities Commission.
